New solid waste regulations

In response to new county regulations regarding solid waste, Lenexa has approved an ordinance that will become effective on Jan. 1, 2012. The ordinance reorganizes the city’s existing solid waste regulations into a more usable format, updates outdated provisions, and eliminates any potential conflicts with the new Johnson County regulations.

Key provisions of the ordinance include:

  • A requirement that haulers provide solid waste and recycling containers, equipped with lids, to all residential customers. The recycling container must be at least the same size as the solid waste container. For haulers not already using compliant containers, this requirement must be met by July 1, 2012.
  • A requirement that all haulers pick up yard waste. To allow time for existing contracts regarding frequency and limits of yard waste collection to be amended, specific requirements regarding frequency will not be fully implemented until January 1, 2013. Haulers must begin yard waste pickup immediately upon the effective date of the ordinance, but pickup may be at the frequency and limits established by existing contracts or where no contracts exist, by the hauler, until January 1, 2013.
  • Yard waste pickup frequency is weekly March through November, and monthly December through February. Yard waste pickup limit is six bags or bundles per pickup, except during October and November when the limit is 10 bags or bundles per pickup. As noted above, these requirements must be fully implemented no later than January 1, 2013.
  • A requirement that, beginning in 2013, each hauler must provide one bulky waste pickup per customer per year with the date of pickup to be scheduled between the hauler and the customer. For the year 2012, the city will still contract for bulky waste pick up as it has done for the past several years.
  • A requirement that on or before January 1, 2015, each licensed refuse hauler which provides solid waste collection service to multifamily residential customers must provide, as part of their basic service charge and not as an optional service, collection of an unlimited volume of recyclables for such customers.
