Lenexa Civic Campus User Conduct Policy

The purpose of the Lenexa Civic Campus User Conduct Policy (“Policy”) is to ensure a safe, secure, and enjoyable environment for all persons participating, observing, or attending (“Users”) any Lenexa Civic Campus (“LCC”) facilities, programs, or events, as well as preserving the functionality of City Hall as a place where business and administrative operations for the City occur. This Policy governs the conduct of all Users of LCC facilities and of any program or activity conducted on the LCC, including, but not limited to, Lenexa City Hall, Lenexa Civic Campus parking garage and common areas, Lenexa Public Market, and any public meetings, special events, or musical/theatrical performances. This Policy sets minimum standards and expectations and is supplemental to City ordinances and other applicable laws (“Laws”). Additional conduct policies or rules (collectively “Rules”) may apply for particular facilities, programs and events including, but not limited to, the Lenexa Rec Center and the Lenexa Farmer’s Market. The facilities, programs, and events offered on the LCC are a privilege and therefore continued enjoyment of such privileges are subject to adherence and observation of this Policy and other applicable Rules.


Hours of Operation

The Lenexa Civic Campus contains two buildings, a parking garage, and several commons areas. The hours of operation for each are as follows:

Lenexa City Hall and Lenexa Public Market*

  • Monday – Saturday: 7:00 a.m. – 9:00 p.m.
  • Sunday: 7:00 a.m. – 8:00 p.m.

Lenexa Rec Center

  • Monday – Friday: 5:00 a.m. – 9:00 p.m.
  • Saturday: 7:00 a.m. – 6:00 p.m.
  • Sunday: 10:00 a.m. – 6:00 p.m.

Civic Campus Parking Garage

  • Monday – Sunday: 4:00 a.m. – 1:00 a.m.

Remaining in any of these facilities outside the hours listed above is a violation of the User Conduct Policy and may subject the User to discipline as provided below. Hours of operation may vary for City-sponsored events. Sleeping or erecting a tent or any other type of temporary shelter on the LCC is prohibited.

* Public Market hours may vary by season, holiday, or special event. Modifications to the hours can be found on the Public Market’s website.


General Conduct Expectations

Users are responsible for reading, understanding and abiding by this Policy and other applicable Laws and Rules. Users of LCC Facilities are expected to:

  • Demonstrate common courtesy and respect towards other Users, LCC Staff (“Staff”) and volunteers;
  • Respect and follow any posted rules, as well as any lawful instructions and/or directions given by Staff or other City personnel.
  • Consume food and drink in designated areas and throw away refuse in the appropriate receptacle;
  • Use all furniture and seating areas appropriately and with respect for other Users;
  • Limit cellular telephone use so as to not disturb or disrupt other Users;
  • Wear appropriate attire at all times, including shoes;
  • Avoid any conduct that unreasonably deprives others of their use or enjoyment of any LCC facility, program or event.

Public Market and Common Consumption Area Rules

The City of Lenexa’s Public Market and Common Consumption Area (“Public Market CCA”) is located on the LCC at the southwest corner of 87th Street Parkway and Penrose Lane. The purpose of these rules is to ensure a safe, secure and enjoyable environment for all persons visiting the Public Market. In addition to the other Rules and Regulations listed in this Policy, the following apply to the Public Market and Common Consumption Area.

  • Public Market CCA Boundaries: The boundaries of the Public Market CCA are clearly marked by signs, physical barriers, and other apparent lines of demarcation. The Market Manager reserves the right to extend or contract the Public Market CCA boundaries.
  • Possession and Consumption Hours: The possession and consumption of alcoholic liquor within the demarcated boundaries of Public Market CCA is permitted daily between the hours of 6:00 a.m. and 12:00 a.m.
  • Removal of Open Containers: No open container of alcoholic liquor shall be removed from demarcated boundaries of the Public Market CCA.
  • Possession and Consumption of Outside Alcoholic Liquor: The possession and consumption of alcoholic liquor purchased outside of the Public Market CCA shall not be permitted within the boundaries of the Public Market CCA.
  • Branded Containers: All alcoholic liquor purchased within the Public Market CCA is served in a container that displays the Market Vendor’s trade name or logo or other identifying mark unique to such Vendor. Patrons are prohibited from removing, tampering with or otherwise altering any trade name or logo or other identifying mark placed upon a container of alcoholic liquor.
  • Additional Restrictions: The City Manager may designate certain City personnel to implement additional restrictions in the Public Market CCA when determined appropriate because of crowd size, type of event, staffing availability, weather, or similar issues. Such additional restrictions may include but are not limited to: restricting areas within the Public Market CCA where alcohol may be possessed or consumed; restricting Public Market CCA hours for the possession or consumption of alcohol; implementing alcoholic drink size limitations or sales limits per individual; or requiring wrist bands to identify persons over 21 years of age.

Inappropriate Conduct

Inappropriate conduct in violation of this Policy and/or failure to observe other applicable Rules may subject the User to discipline depending on the nature, frequency, and severity of the offense. LCC Staff reserves the right to determine appropriate discipline, up to and including banishment of the User, for any inappropriate conduct which occurs while User is participating, observing, visiting, or attending any LCC facility, program or event. Such inappropriate conduct includes but is not limited to, the following:

  • Sleeping or erecting a tent or any other type of temporary shelter on the LCC is prohibited;
  • Engaging in disorderly, disruptive, unsafe conduct or any conduct that interferes with the use of any facility, program or event by other Users or with the functioning of Staff. Such conduct includes, but is not limited to brawling, fighting, physical abuse, inappropriate physical contact, disruptive outbursts, use of profanity or indecent language, verbal abuse, harassment, spitting, gambling, and roughhousing.
  • The creation or broadcast of any amplified sound that results in discomfort or annoyance to a reasonable person is strictly prohibited. This specifically applies to the use of electronic or other devices, including but not limited to laptops, tablets, cell phones, radios, music players, and phone or video conversations. Such devices may be used with headphones or other personal audio equipment provided that such use prevents improper amplified sound;
  • Destruction, damage or theft of public property, equipment or supplies or the property of other Users;
  • Illegal drug use or the unauthorized drinking of alcoholic or cereal malt beverages on the LCC or at an LCC program or event;
  • Smoking in any restricted area as detailed more fully in Lenexa City Policy AD-General-2;
  • Improper use of furniture and seating areas could include but would not be limited to sleeping, on, under, or near tables or benches or otherwise using benches and seating areas in a way that prevents other Users or visitors from using or enjoying them;
  • Parking or leaving unattended any bicycle or scooter or similar device in any area of the LCC except those areas specifically designated for such device parking;
  • Leaving unattended items within City facilities or on any public property within the LCC (Note: unattended property may be removed by City staff without prior notice. City Staff may, within its sole discretion, retain or dispose of such unattended/abandoned property as it deems fit);
  • Use of City facilities for personal hygiene and grooming;
  • Use of and/or refusal to leave the LCC or an LCC amenity, program, or event when reserved for the exclusive use by another User or a City event.
  • Committing any violation of law or City Code;

The examples of unacceptable conduct listed above are published for Users’ information and serve as a guide for conduct when participating, observing or attending any LCC facilities, programs and events. The list is not meant to be all-inclusive, and other circumstances may arise which are inappropriate and may justify disciplinary action. The City of Lenexa recognizes that each situation which may arise at any LCC facility, program or event will present a unique set of circumstances. Each situation will be addressed based on its own facts and in the context of relevant surrounding circumstances.


Disciplinary Actions

In order to provide a functional system for handling disciplinary situations, the City of Lenexa has developed discretionary guidelines for applying disciplinary action. These disciplinary guidelines do not create any property right or interest. The disciplinary guidelines include any of the following disciplinary actions which may be used when, in the sole judgment of City staff, they are justified. These actions are not exclusive and are not required to be implemented in a progressive manner:

  • Verbal warning of violation: A verbal warning is an oral notice of violation of the Policy or other applicable Rules given by Staff to the User(s).
  • Immediate ejection of User(s) from the facility, program or event: Immediate ejection shall mean the removal of the User(s) from the facility, program or event, and banishment from any other LCC or City of Lenexa facility, program or event for the remaining hours of operation on the day of removal.
  • Suspension of User(s) from LCC privileges: Suspension of LCC privileges shall mean a temporary denial of access to the facility, program or event for a period of one (1) or more days, but less than one (1) year. The effective date and length of the User’s suspension shall be determined by the Deputy City Manager or designee, depending upon the scope and severity of the violation. Notice of such suspension shall be made in writing.
  • Banishment of User(s) from LCC or City of Lenexa facilities, programs, or events: Banishment from LCC facilities, programs, or events shall mean a denial of access to any LCC facility, program, or event for one (1) year or more. The effective date, scope and length of the banishment shall be determined by the Deputy City Manager or designee, depending upon the scope and severity of the violation. Notice of the Banishment shall be made in writing.
  • Criminal sanctions or any other remedy available under local, state or federal laws.

The appropriate disciplinary action for any conduct in violation of this Policy or other applicable rules will be determined in the sole discretion of City Staff. These disciplinary actions may be applied cumulatively. Staff or other City personnel have the right to contact the Lenexa Police Department as it deems necessary.

Appealing a Disciplinary Action

Anyone who, in accordance with this Policy or other applicable Rules, has been suspended or banished from any LCC facilities, programs, or events for seven (7) or more days (the “Violator”) may appeal the suspension by submitting a written request (“Appeal”) to the City Manager within five (5) business days of the date of the notice of any suspension or banishment (“Notice”). Appeals must be filed with the Lenexa City Clerk at Lenexa City Hall, 17101 W. 87th St. Pkwy, Lenexa, KS 66219 and must include any and all explanation and supporting documentation the Violator wants the City Manager to consider in making their determination.

Upon Timely receipt of an Appeal, the City Manager or designee shall have five (5) business days to review the Appeal and issue their decision to: (i) uphold the suspension or banishment or (ii) upon a showing of good cause, the City Manager may modify or lift the suspension or banishment. In making their determination, the City Manager may contact the Violator and/or consult with Staff and other City personnel to obtain additional information or clarification, but they are not required to do so. The City Manager’s decision will be provided to the Violator in writing by placing it in the U.S. Mail and/or hand-delivery. The City Manager’s decision shall be considered final.

During any appeal process as provided by this Policy, the suspension or banishment will remain in place unless or until it is modified or otherwise lifted.

The City of Lenexa reserves the right to modify or amend the rules and procedure provided herein at any time.
