Commercial Temporary Certificate of Occupancy

Do you want to temporarily occupy a commercial space before you have an approved final inspection? The City of Lenexa allows licensed contractors to request a Temporary Certificate of Occupancy in some instances.

You must apply for, pay fees and receive the approved and signed Temporary Certificate of Occupancy prior to occupying the space.

Step 1.Application requirements

During a final inspection, if the inspector finds that your project meets requirements to be considered for a Temporary Certificate of Occupancy, it will be noted on the inspection ticket. The inspection comments will list any deficiencies as well as how many days are approved for the temporary occupancy.

Step 2.How to apply

The general contractor or an authorized agent must apply for the Temporary Certificate of Occupancy after a final inspection has been performed by a building and/or fire inspector.

The application will ask for a list of deficiencies and the length of time necessary to complete the items. If extenuating circumstances will prevent you from completing items within the time indicated by the inspector, provide that information.

You can start the application now, save your progress and come back to finish it later, if necessary. The review will not begin until the application is submitted in full, and application fees are paid.

Step 3.Fee payment

Once we have the completed application, City staff will notify you via email that a $100 application fee is ready to be paid in our application and permit portal

Step 4.Review process

Temporary Certificate of Occupancy applications are processed within one business day and then routed to Building staff for review. If they need any clarifications or have questions, they will get in touch with the person who submitted the application.

 We will send you an email outlining the status of your request. 

Step 5.Issuing your certificate

Once temporary occupancy is approved, we will email you the Temporary Certificate of Occupancy for your signature. After you receive and sign it, you will be authorized to temporarily occupy your space.  

Step 6.Expiration

Please make note of the Temporary Certificate of Occupancy expiration date. If you do not complete the deficiencies and request an inspection prior to the expiration date, you must request an extension.
